Rules for selling your own produce

EU rule

  • Regulation (EC) No 852/2004, Art. 1(2)(c) and 1(3). EU food hygiene Regulation 852/2004 does not apply to direct supply, by the producer, of small quantities of primary products to the final consumer or to local shops that supply the final consumer directly (Art. 1(2)(c)). Each member state sets national rules for this (Art. 1(3)). (source, checked 7 October 2026)

National rules

  • BOFiP BOI-BA-CHAMP-10-10-10, § 20. French tax guidance (BOFiP): gardens under 5 ares (500 m²) that adjoin a building and belong to the same owner are exempt from income tax on agricultural profits; vegetables grown only for the taxpayer's family are not taxed when the taxpayer is not a farmer.
