Rules for selling your own produce

EU rule

  • Regulation (EC) No 852/2004, Art. 1(2)(c) and 1(3). EU food hygiene Regulation 852/2004 does not apply to direct supply, by the producer, of small quantities of primary products to the final consumer or to local shops that supply the final consumer directly (Art. 1(2)(c)).   • Gewerbeordnung 1994, § 2 Abs. 1 Z 1 und Abs. 3 Z 1. Austrian Trade Act 1994, §2: the act does not apply to agriculture and forestry, which includes producing plant products with the help of natural forces, including fruit growing, horticulture and nurseries. (source, checked 7 October 2026)
